Whistleblowing has now become everyone's business!

Whistleblower systems enable companies to meet the new compliance regulations. They create the channels needed for employees, customers, suppliers or any other business partners, to report compliance-relevant irregularities anonymously. These include legal violations such as money laundering or discrimination. In addition, going forward, companies are obliged to process these reports with an appropriate time period. The EU Whistleblower Directive obligates the following organisational structures to introduce a reporting system:

  • All companies with 50 or more employees
  • Companies with an annual turnover of more than EUR 10 million
  • Official authorities and municipalities
  • Companies operating in the financial sector, regardless of size
  • Many other organisations such as clubs, associations, churches, universities, and public hospitals, will also comply.

The systems are designed to protect whistleblowers and to make things easier to report. This gives companies the opportunity to handle grievances internally before they go public, or become the subject of a legal dispute.

But, new risks are also created. General managers may be held personally liable in the absence of instituting a whistleblower system, or if the reports are not processed in a timely manner. In addition, whistleblowers will be led to release information publicly, if a report is not properly dealt with. This may disembogue into reputational damage as well as major financial damages.

The Whistleblower's Section

Whistleblowers can submit an anonymous report here. All you have to do is fill out a predefined questionnaire. The boxes for entering information are easy to understand so as to avoid any difficulties when entering data. The system can be individually adapted to your company. Whistleblowers are able to inform themselves on the legal requirements, as well as receive explanations on system security and anonymity. Whistleblowers are allocated a PIN and a case processing number. It enables them to log into the system at any time, to answer questions, or to provide further information.

The Case Processing Section

Here you can process the report in accordance with legal requirements. You will be able to see and manage your deadlines as well as follow up on all information, at any time, anonymously. In addition, you can split up, or restrict, processing within your compliance team in order to ensure added security. The software enables you to export and save overviews of current and completed notification procedures at any time. Your compliance team can also communicate with the whistleblower anonymously, via the case processing section, ask questions, or obtain further information.

Creating reports via predefined steps

whizzla can be accessed via a link, a barcode or utilising a link created on your organisation's website. When submitting the report, the whistleblower is guided through a form and a questionnaire, ensuring that all important information is provided. Before the notification is sent, the whistleblower receives an individualised password. It is the only way to gain access when cited together with the case number.

Reports are confirmed and sent to the whistleblower within 7 days

The compliance department receives an email informing them that a new report has been received. You should then log in to whizzla to ensure that the report is accepted within the given timeline. The compliance department can see all processes and  processing status in the dashboard overview. After accepting a report, a whistleblower is informed that a member of the compliance department has been entrusted with the report.

Anonymous & protected communication during processing

Whistleblowers can log in with their PIN and case number at any time and view their report's current processing status. You can also communicate anonymously, via a secured system, with the compliance department. The report can now be followed via a chat function so that further information can be obtained if necessary.

The final remedial report is sent to the whistleblower after 3 months

After successful processing and resolution of the report, the case can be closed. This can be done by the compliance department or the whistleblower. All data relating to a report are still available to the compliance department and will only be deleted (automatically) after 6 months. The whistleblower also has access to the resolved case via the  access data, until the case is deleted.

Background to the EU directive and its implementation

The EU Whistleblower Directive had to be implemented into national law by all member states by the 17th of December, 2021.

If it is not implemented, the Directive will take effect immediately, even without being entered into national legal statutes. The objective of this Directive is to synchronise whistleblowing procedures within wide areas of the economy, industry, as well as public sector. The guidelines define the standards for the protection of whistleblowers. Not all EU countries have implemented it yet. However, no  institution should wait any longer due to the risk of fines and possible damages to reputation if such an organisation has failed to set up, or simply set up an inadequate reporting channel.

No, because the guidelines are fully applicable since the 17th of December, 2021, even without Germany having implemented this law. So it is better to act now.

The EU has set a standard for all member states. whizzla offers the option to register several organisations so that your other branches, or locations in other countries, can be dealt with individually.

The following criteria currently apply to companies:  For companies that employ more than 50 people, or less than 50 but have an annual turnover of more than EUR 10 million, a whistleblower system is mandatory. Also, if it falls under the Money Laundering Act.
